NOT FINANCIAL ADVICE

You acknowledge and agree that:

• All trading and investment decisions are solely your responsibility
• TradePsych does not recommend buying, selling, or holding any financial instruments
• Past performance does not guarantee future results
• Trading involves substantial risk of loss and is not suitable for everyone
• You should consult with a qualified financial advisor before making investment decisions
• Our AI coach provides psychological guidance and interpretive analysis, not actionable trade recommendations

User Eligibility

You must be at least 18 years old to use TradePsych. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

Account Registration

To use TradePsych, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or abusive behavior.

Subscription and Payment

Pricing

TradePsych offers various subscription tiers with different features and pricing. Current pricing is displayed on our website and may be changed with reasonable notice.

Billing

Subscriptions are billed monthly or annually in advance. By subscribing, you agree to:

• Provide valid payment information
• Authorize automatic recurring charges
• Pay all applicable fees and taxes
• Update payment information if it changes or expires

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months or unused features.

Usage Limits

Each subscription tier includes specific usage limits (e.g., number of AI coaching sessions, screen analyses). Exceeding these limits may result in service restrictions or additional charges.

Acceptable Use

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or hack the Service
• Share your account credentials with others
• Abuse, harass, or send inappropriate content to the AI coach
• Use automated tools or bots to access the Service
• Extract or scrape data from the Service
• Interfere with or disrupt the Service's operation
• Violate any applicable laws or regulations
• Impersonate any person or entity
• Upload malicious code, viruses, or harmful content

Violation of these terms may result in immediate account suspension or termination.

Intellectual Property

TradePsych and all related content, features, and functionality are owned by TradePsych and protected by copyright, trademark, and other intellectual property laws.

You retain ownership of your personal data and trading information. By using the Service, you grant us a limited license to process your data as described in our Privacy Policy.

AI-Generated Content

The AI coach's responses are generated by artificial intelligence and may not always be accurate or appropriate. You acknowledge that:

• AI-generated content is provided "as is" without guarantees
• The AI may occasionally produce errors or inappropriate responses
• You should use critical thinking and professional judgment
• TradePsych is not liable for decisions made based on AI guidance

Service Availability

We strive to provide reliable service but cannot guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance
• Technical issues or outages
• Third-party service disruptions (OpenAI, ElevenLabs, etc.)
• Force majeure events

We are not liable for any losses resulting from service interruptions.

Limitation of Liability

Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless TradePsych, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your trading decisions and outcomes

Termination

We may suspend or terminate your access to the Service at any time, with or without cause, including for:

• Violation of these Terms
• Fraudulent or abusive behavior
• Non-payment of fees
• Prolonged inactivity
• Legal or regulatory requirements

Upon termination, your right to use the Service ceases immediately. We may delete your data in accordance with our Privacy Policy.

Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service. Your continued use after changes indicates acceptance of the modified Terms.

Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in courts located in the jurisdiction where TradePsych is headquartered.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
